Common Questions

Should I arbitrate or go to court?

Arbitration offers privacy and a choice of tribunal, but is not always faster or cheaper. The contract usually decides, so check your arbitration clause first.

How does SIAC arbitration work?

Broadly, one party files a notice of arbitration, a tribunal is appointed, both sides present their case, and the tribunal issues a final award. Procedure and costs depend on the rules and the dispute.

Can an arbitral award be enforced or set aside?

Awards can generally be enforced like court judgments with the court's permission. Setting one aside is only possible on limited grounds, so strict deadlines and careful advice matter.

Is a mediated settlement binding?

The mediation itself is not binding, but once the parties sign a settlement agreement it is generally enforceable, and in suitable cases can be recorded as a court order.
